At Mehtani Law Offices, P.C., our Beverly Hills employment law attorneys know that California laws change throughout the year, and Senate Bill 848 (SB 848) is the latest in multiple bills that have passed requiring additional workplace leave for bereavement.
Here is what California employees need to know about the newest law.
Senate Bill 848: Reproductive Loss Leave
Last year, the California Legislature passed Assembly Bill 1949 (AB 1949), which required California employers with five or more employees to offer five days of unpaid bereavement leave to employees upon the death of a qualifying family member.
On October 10, 2023, California enacted SB 848, which requires California employers with five or more employees to offer up to five days unpaid leave when an employee suffers a reproductive loss event.
This may include a
- Failed Adoption.
- Failed Surrogacy.
- Miscarriage.
- Stillbirth.
- Unsuccessful assisted reproduction.
Employers are only mandated to provide reproductive loss leave to employees employed by the employer for at least 30 days.
Employees must take such leave within three months of the reproductive loss event, and if an employee suffers multiple reproductive loss events, they are limited to 20 days of leave in 12 months. Though the leave is unpaid, employees must be allowed to use any accrued paid leave, including paid sick leave.
SB 848 mandates employers maintain the confidentiality of any employee requesting reproductive loss leave and is silent as to whether employers can request documentation supporting such leave. Employers are prohibited from retaliating against employees for requesting reproductive loss leave.
